GENERAL CONDITIONS OF USE: BATMAP.COM
These general conditions regulate the provision of the services
that BATMAP offers to the users on the page http://www.batmap.com.
The use of said services by the users implies full and unreserved
acceptance of the present general conditions of use.
In the event that the provision of all or some of the services
by BATMAP were to require personal details to be provided and registered
by the users, the latter undertake to provide true data, notifying
BATMAP of any change thereto pursuant to the conditions set forth
in the DATA PRIVACY POLICY.
1.- PROVISION OF THE SERVICES
- The users' access to the BATMAP page and the use of the services
included thereon is, in general terms, free of charge.
- Notwithstanding, BATMAP reserves the right to establish payment
of a fee or charge in consideration of the use of all or some of
the services it offers. The price, payment conditions and duration
or term of the service provision will be expressly communicated
to the user with the appropriate advance notice.
- Provision of any of the services may be subject to special or
specific conditions. In this case, said conditions will enjoy preference
over all points not included in the present conditions.
- BATMAP reserves the right to modify the present general conditions
at any time. Any change will be communicated to the user through
the web page: http://www.batmap.com
2.- INTELLECTUAL PROPERTY RIGHTS
- Both the web page, batmap.com, as an original and distinctive
creation belonging to BATMAP, S.A., and the totality of the elements
included thereon are protected by the Intellectual Property laws.
This protection covers:
a) The guide created and published by BATMAP, S.A. (BATGUIDE) and,
therefore, the totality of the contents thereof, information, images,
format, software, design, buttons, icons and colour combination
and structure, lay-out and presentation.
b) The software or geographic browser that allows the services of
finding on maps in real time.
c) The Intellectual Property rights over the rest of the elements
included in the BATMAP web (digital maps) belong to BATMAP or to
third-party suppliers.
- Public communication of the contents or information provided
in BATGUIDE does not, under current legislation, imply that BATMAP
in any manner waives the Intellectual Property rights it holds.
- Consequently, by means of acceptance of the present general conditions,
the user obtains a LICENCE FOR PRIVATE, NON PROFIT-MAKING, NON-EXCLUSIVE
AND NON-TRANSFERABLE USE over each and every one of the elements
included in BATMAP.COM.
In accordance with the purpose of use established, the user may
not:
- Copy or reproduce, fully or partially, the contents, information,
designs, titles, including the lay-out or format, excepting the
right to make copies for strictly private use or reproductions in
the caché memory of the computer, provided that this is automatic,
provisional, temporary and for private use and does not involve
any modification or alteration of the contents provided.
- Distribute the contents provided by the sale, rental or loan thereof
or in any other way or to communicate them publicly by including
them in any kind of dissemination network.
- Likewise, the user may not transform (translate, adapt or modify)
the elements included on the web page, the information or the contents.
- Copy, distribute, translate, disassemble, decompile, invert, merge,
combine, adapt or modify the software or code belonging to BATMAP
The user may not alter or delete, even on private copies, the present
legal information provided by BATMAP to regulate the use of the
rights it holds.
3. INDUSTRIAL PROPERTY RIGHTS
All the distinctive signs included in the gateway BATMAP.COM (trademarks,
logotypes, industrial designs, tradenames, etc.) and domain names
belong to BATMAP or to third-part collaborators.
Access to the gateway and the users' use of the services on offer
does not imply the granting of a licence of use (full or partial)
over said rights.
4. USE OF THE SERVICES
- The user undertakes to use the services in accordance with the
law, the morality and the correct practices generally accepted in
the use of services provided through the Network. Merely as examples,
the user undertakes not to use the services for the following purposes:
- Express opinions (chats, forums, messages, etc.) that infringe
the law or rights of any kind recognised to third parties (individuals
or legal entities) or promote criminal offences or acts that contravene
the law, morality or public order.
- Provide contents that are false or inaccurate or that may induce
errors on the part of those receiving them.
- Send e-mails or advertising messages (to a single person or en
masse) without the prior authorisation of those receiving them.
- Send chain messages to a number of people without the prior consent
of those receiving them.
- Use the e-mail or postal addresses accessible through use of the
service for purposes other than those stated specifically.
- To establish a link without the prior express authorisation of
BATMAP.COM.
- BATMAP reserves the right to eliminate any opinions, information
or contents provided by the users in any of the media it offers
(chats, forums, etc.) if they do not meet the provisions of the
present clause.
- BATMAP reserves the right to eliminate temporarily (maintenance
or updating tasks) or definitively the provision of all or some
of the services on offer at BATMAP.COM.
5. LIABILITY
5.1. BATMAP provides the user with a complete guide with original
contents, prepared following quality processes and parameters, in
which the user is offered information on determined aspects related
to different cities, itineraries, recommended places, events, etc.
5.2. BATMAP does not guarantee that said contents or information
meet any expectations on the part of the user or are appropriate
for meeting a specific end. Likewise, it will not be liable for
defects in the contents, deficiencies, errors or lack of updating.
5.3. BATMAP, as a simple intermediary AGENT, is not liable for the
contents or opinions given by the users in forums, chats or debates.
Notwithstanding, if it is aware of them, BATMAP reserves the right
to eliminate any contents that may be illegal, affect rights recognised
to people, constitute or incite to the commission of an offence,
or, in general contravene morality or correct practices or damage
the good image and name of BATMAP.
5.4. BATMAP is not liable for any damages or prejudicial consequences
(direct or indirect) that may be derived from the user of the services
on offer. Specifically, it will not be liable for:
- The inappropriateness of the service for meeting any expectations
that the user may have.
- Specific or temporary failures in the use of the service (access,
view, etc.).
- The transmission of virus that exist in the network through use
of the services.
- Possible damages to the users' equipment or operating systems
or the loss of information, the origin of which was caused by the
incorrect use or installation of the services provided by BATMAP.
6. APPLICABLE LEGISLATION
The present general conditions, together with any relationship
that may arise between the parties on the basis thereof, are governed
by Spanish legislation.
The parties, waiving any other forum that may correspond to them,
submit themselves to the Courts and Tribunals of the city of Madrid
for any conflict that may arise from the interpretation or execution
of the present general conditions.
